Selling an Indian property while living overseas is a project in its own right. The seller needs a commercial plan, legal documentation, tax strategy, buyer coordination and a banking route for the proceeds.

1. Build the sale file

Collect the purchase deed, title records, loan closure documents if applicable, tax receipts, improvement records, PAN and bank information. If the property was inherited, collect the inheritance documents.

2. Establish market value

Obtain a realistic valuation based on comparable transactions and the property's actual condition. A price that is too high can extend the selling period; a price that is too low can destroy value.

3. Verify the buyer and transaction structure

Confirm the buyer's identity, funding and proposed payment schedule. All payments should be documented and routed through the appropriate banking channels.

4. Plan TDS and capital gains

An NRI seller should obtain tax advice before signing because withholding and final tax liability are separate issues. Current tax rules should be checked for the transfer date.

5. Execute the sale

Coordinate agreement, signatures, registration and receipt of consideration. If you cannot attend personally, confirm whether a valid POA is required.

6. Plan repatriation

After tax and documentation requirements are addressed, coordinate with the authorised dealer bank on the permitted remittance route. The bank may need evidence of acquisition, sale and taxes.

7. Close the ownership file

Retain the registered sale deed, tax documents, TDS evidence, bank statements, remittance paperwork and correspondence. These records may be needed later for tax or audit purposes.
